EVEN-KEEL TOTES RENTAL AGREEMENT
Even-Keel Totes (“Company”) is a reusable tote rental business owned and operated by Bubba and Jeri-Ann Keel. By submitting a reservation, completing payment, accepting or picking up rental equipment, clicking to accept these terms, or otherwise using equipment provided by Even-Keel Totes, the customer (“Customer”) agrees to the terms of this Rental Agreement.
1. Rental Period The rental period begins on the scheduled delivery or customer pickup date and ends on the scheduled return or Company pickup date shown on the reservation. Rental periods are offered in 1-, 2-, 3-, and 4-week increments. Customer agrees to have all rented equipment available and ready for return at the end of the scheduled rental period. Extensions must be requested before the scheduled return date and are subject to availability.
2. Payment Full payment is due at the time of booking to reserve the Customer’s rental dates and inventory. No security deposit is required unless otherwise stated for a specific reservation. After the original payment, additional charges may apply for approved rental extensions, late returns, missing equipment, damaged equipment, excessive cleaning, missed delivery or pickup appointments, or other charges permitted under this Agreement. If additional charges are owed, Even-Keel Totes may provide the Customer with an invoice using the contact information supplied at booking. Unless otherwise stated on the invoice, additional balances are due within 7 days. Current additional charges may include: Rental extension or late return: $15 per additional week, or portion thereof Missing or unreturned tote: $20 per tote Missing or unreturned lid: $5 per lid Equipment damaged beyond reasonable use: repair or actual replacement cost Excessive cleaning: reasonable cleaning charge based on the condition of the equipment Missed delivery or pickup caused by Customer circumstances: reasonable additional service charge Failure to pay amounts legitimately due under this Agreement may result in collection efforts as permitted by applicable law.
3. Customer Care and Use of Equipment Customer agrees to use reasonable care when handling and storing all Even-Keel Totes equipment. Totes and accessories may be used for ordinary moving, organizing, renovation, decluttering, storage, staging, and similar lawful purposes. Rented equipment must not be used to store or transport hazardous materials, chemicals likely to damage the equipment, wet paint, loose food, liquids likely to leak, garbage, or other substances that may cause permanent staining, odors, contamination, or damage. Customer may not sell, lend, transfer, sublease, modify, permanently mark, cut, drill, paint, or otherwise alter rented equipment.
4. Responsibility for Rented Equipment Customer is responsible for rented equipment from the time it is delivered to or picked up by the Customer until it is physically returned to or collected by Even-Keel Totes. Customer is responsible for protecting equipment from loss, theft, destruction, misuse, and unreasonable damage. Normal scratches, scuffs, and wear resulting from ordinary moving and household use are expected and will not be treated as damage. Equipment that is lost, stolen, destroyed, or damaged beyond normal use may be subject to repair or replacement charges.
5. Rental Extensions and Late Returns Customers needing additional rental time should contact Even-Keel Totes before the scheduled return date. Extensions are not automatic and depend upon upcoming reservations and available inventory. When an extension is approved, an additional rental fee of $15 per week, or portion thereof, may apply. If equipment is not returned or available for pickup as scheduled and no extension has been approved, additional rental charges may continue until all equipment is returned.
6. Delivery, Pickup and Customer Pickup/Return Even-Keel Totes may offer both Delivery & Pickup and Customer Pickup & Return, depending on the Customer's location and reservation. For Company delivery or pickup, Customer agrees to provide an accurate address and safe, reasonable access to the property. Customer is responsible for ensuring that pets, gates, vehicles, construction activity, or other conditions do not prevent safe access. If a scheduled delivery or pickup cannot reasonably be completed because the Customer is unavailable, the property is inaccessible, conditions are unsafe, or information supplied by the Customer is incorrect, an additional service charge may apply. For Customer Pickup & Return reservations, equipment must be collected and returned at the designated Even-Keel Totes location during the agreed appointment window. At the end of every rental, totes should be empty, accessible, and ready for return or pickup.
7. Inventory Verification Even-Keel Totes may use inventory records, QR asset tracking, photographs, video, written documentation, or other reasonable methods to document the number and condition of totes and accessories issued and returned. Customers should report any discrepancy in tote counts or equipment condition promptly after receiving their rental. Company records may be used to help resolve questions regarding missing or damaged rental equipment.
8. Cleaning Every tote is cleaned and sanitized between rentals. Customers are not expected to professionally clean totes before returning them. However, equipment should be returned reasonably free of garbage, food, liquids, excessive dirt, chemicals, paint, adhesives, strong odors, hazardous substances, or other contamination. Equipment requiring cleaning substantially beyond normal post-rental sanitation may be subject to a reasonable cleaning fee.
9. Personal Property Even-Keel Totes provides rental equipment only and does not take custody of, insure, or accept responsibility for Customer belongings placed inside the totes. The Company is not responsible for loss, theft, breakage, water damage, or other damage to items placed inside or transported in rented equipment, except to the extent liability cannot legally be excluded. Customers are responsible for appropriately packing, protecting, lifting, transporting, and securing their belongings.
10. Safe Use Customer assumes responsibility for the reasonable and safe handling of totes, dollies, Tote Taxis, and any other rented accessories. Customers should not overload equipment beyond its reasonable intended capacity and should use appropriate care when stacking, lifting, loading, transporting, or moving rented equipment. Even-Keel Totes is not responsible for injuries or property damage resulting from misuse, overloading, unsafe stacking, improper lifting, or other improper use of rented equipment, except where applicable law provides otherwise.
11. Delays and Circumstances Outside Our Control Even-Keel Totes will make reasonable efforts to meet scheduled delivery and pickup arrangements. The Company is not responsible for reasonable delays caused by severe weather, road conditions, traffic accidents, vehicle or equipment failures, emergencies, governmental restrictions, or other circumstances outside the Company's reasonable control. When such circumstances occur, Even-Keel Totes will make reasonable efforts to communicate with the Customer and arrange an alternative time.
12. Indemnification To the extent permitted by Texas law, Customer agrees to indemnify and hold harmless Even-Keel Totes, Bubba Keel, Jeri-Ann Keel, and the Company's employees or representatives from claims, losses, liabilities, damages, or expenses arising from the Customer's possession, misuse, negligent use, or unauthorized use of rented equipment.
13. Governing Law This Rental Agreement shall be governed by and interpreted according to the laws of the State of Texas.
14. Acceptance of Agreement By submitting a reservation, completing payment, accepting delivery, picking up equipment, clicking an electronic acceptance box, or using Even-Keel Totes equipment, Customer acknowledges that they have had an opportunity to review this Rental Agreement and agree to its terms. The version of the Rental Agreement in effect at the time a reservation is made will govern that reservation.
